By purchasing or using an XPI SmartCard or related products (keychains, wristbands, metal cards, etc.), you (“Client”) agree to the following Terms & Conditions with XPI Solutions LLC (“Company”).
1. Product Description
- XPI SmartCard is a digital contactless business card that uses NFC/QR technology to share information.
- Add-ons such as wristbands, keychains, and upgrades are available.
- Lead capture, booking, and payment features are included only in certain packages (Pro & Enterprise).
2. Payment & Pricing
- All sales are final. Prices are listed on the intake form and may change without notice.
- Payment must be made in full at the time of order.
- Taxes and shipping will be applied where applicable.
- Discount codes are valid only if entered at checkout.
3. Shipping & Delivery
- Standard Ground Shipping (3–5 business days) or Express (1 business day) options are available.
- XPI is not responsible for carrier delays, lost, or damaged packages once shipped.
- Risk of loss passes to the Client upon delivery to the carrier.
4. Usage & Responsibility
- The Client is solely responsible for the information uploaded to their SmartCard.
- XPI Solutions is not liable for misuse of data, inaccurate information, or how third parties use shared contact details.
- NFC functionality may vary by phone/device.
5. Warranty & Limitations
- Physical SmartCards come with a 30-day warranty against manufacturing defects.
- Software/landing page functionality is warranted for 30 days from launch.
- XPI is not responsible for third-party hosting, domain, or plugin issues.
6. Intellectual Property
- All software, coding, and design remain the property of XPI Solutions until fully paid.
- Clients may not resell or duplicate XPI SmartCard designs without written permission.
7. Refunds & Returns
- Due to the custom nature of SmartCards, refunds are not provided except in cases of defective products.
- Defective products must be reported within 7 days of receipt.
8. Liability Limitation
- In no event will XPI Solutions be liable for damages exceeding the purchase price of the product.
- XPI Solutions is not responsible for lost leads, missed opportunities, or reliance on the SmartCard.
9. Affiliate Sales
- Affiliates may promote XPI SmartCard under a separate Affiliate Agreement.
- XPI reserves the right to terminate affiliates who misrepresent or abuse the program.
10. Governing Law
- This Agreement is governed by the laws of the State of Texas (USA).
